roy oliver - murder in texas

I spent a few minutes search for the actual arrest record in dallas county ... it isnt online yet. :P

THEY REALLY need to include a manslaughter charge, otherwise the jury will find him not guilty. ... shudder ...
The INTENT will be called into action, and there will be reasonable doubt.


charged with "murder" is common people speak. it is not a legal thing.

texas doesnt use "first degree murder", but capital murder.
one these two:
The defendant intentionally and knowingly caused the death of another person;
The defendant intended to cause serious bodily injury and committed an act that was clearly dangerous to human life and this act caused the death of an individual;

his defense would be:
Lack of intent
Insanity

Second Degree or "Murder" in Texas
I am assuming that this is different from first degree, in lacking premeditation. same defense ...

Manslaughter ...
To be convicted of manslaughter, a defendant must be proven beyond reasonable doubt to have recklessly caused the death of another person. As opposed to murder, intent does not need to be proven in order to convict someone of manslaughter.
